Hong Kong's vibrant economy and strategic location make it an attractive destination for entrepreneurs. The city offers an ‘Investment Visa’ or Entrepreneur Visa, specifically designed for foreign entrepreneurs aiming to establish and operate their own business in Hong Kong.

This visa is a work permit issued to business owners, allowing them to reside and manage their business activities in the city.

Understanding the Investment Visa

The Investment Visa, officially named the ‘Investment as Entrepreneurs’ scheme, is issued by the Hong Kong Immigration Department (ImmD) under the General Employment Policy. This visa facilitates entrepreneurs who are committed to making a substantial economic contribution to Hong Kong.

Eligibility Criteria

To qualify for an Investment Visa, applicants must meet several requirements:

• Clean Criminal Record: Applicants must have no criminal record.

• Educational Background: Typically, a university degree is required. However, exceptions can be made for individuals with outstanding technical qualifications, professional abilities, or significant experience.

• Economic Contribution: Applicants must demonstrate that their business will benefit Hong Kong's economy. This includes creating local jobs, using local suppliers, introducing new technologies, and contributing to the specific market sector.

• Incorporated Company: The business must be incorporated in Hong Kong before applying for the visa.

It is important to note that this scheme does not apply to residents of mainland China and nationals of Afghanistan, Cuba, Laos, North Korea, Nepal, and Vietnam.

Documentation Requirements

Applicants for an Investment Visa need a local sponsor who could be a company or an individual responsible for their repatriation if necessary. The documentation required includes:

From the Applicant:

• Completed Investment Visa Application Form with a recent photograph.

• Passport copy (including personal particulars page and latest arrival stamp/landing slip if in Hong Kong).

• Hong Kong ID card copy, if available.

• Proof of overseas residence.

• CV and academic qualifications/work experience.

• Employment Contract or Appointment Letter detailing job position, salary, and employment duration.

• A detailed two-year business plan.

• Business Registration Certificate of the company.

From the Sponsor:

• Completed Sponsor Application Form.

• Business Registration Certificate (if the sponsor is a company).

• HKID card and passport copy (if the sponsor is an individual).

All documents must be in English or Chinese, or translated into these languages by a certified translation body. The Immigration Department may request additional documents if necessary.

Crafting a Strong Business Plan

A compelling business plan is a critical component of the Investment Visa application. It must include:

• Business Idea and Market Analysis: Clearly outline the product or service, market potential, and the business’s expected contribution to Hong Kong's economy.

• Operational Plan: Details about the administrative and management team, operational strategies, and business premises.

• Capital Investment: Evidence of sufficient funding to cover start-up and operational costs for the initial 3 to 6 months.

• Business Entity: A limited liability company incorporated in Hong Kong is often viewed more favourably than other business structures.

For a higher chance of approval of your visa application, it is important to invest time and effort into writing a solid business plan, instead of merely meeting the bare minimum requirements. This is your opportunity to put your best foot forward and show your commitment to contributing to Hong Kong’s economy.

Application Process and Timeline

Once all documents are prepared, the application can be submitted to the Hong Kong Immigration Department either online, by post, or in person at the nearest Chinese diplomatic and consular mission.

Processing typically takes about 4 weeks. Successful applicants receive an e-Visa, which must be presented upon entering Hong Kong.

The initial validity of the Investment Visa is 3 years or the employment contract duration, whichever is shorter. Extensions can be applied for 4 weeks before the visa expiry.

Dependant Visa and Permanent Residency

Investment Visa holders can apply for dependant visas for their spouse and unmarried children under 18. Dependant visa holders can work, study, and live in Hong Kong without restrictions.

After 7 years of continuous residence, Investment Visa holders may apply for Permanent Residency, granting them the right to live and work in Hong Kong indefinitely.
